JUDGEMENT

(1.) This revision petition has been preferred by the petitioner Nihal Singh s/o Mohan Lal, r/o Bhandala , Tehsil Nim-ka-Thana, District Sikar, against the order dated 12.08.2010, passed by the learned Addl. District & Sessions Judge(Fast Track) No.2, Pali in Sessions2 Case No.02/2010, whereby the learned Addl. District & Sessions Judge framed charges against the petitioner under section 302, 397, 201 and 414/511 IPC.

The brief facts of the case, giving rise to the present revision petition, are that a FIR was lodged by one Laxman Sen on 07.07.2007 with the averments that on 07.07.2009 at about 04.30AM he got up and walked towards the pond nearby the road going towards Marwar, there he saw dead bodies of two persons lying on the road about 1 Km. away from Jadan Circle. It was further alleged that the head of both deceased persons were mashed and marks of the tyre of truck was seen on them. The name 'V.K.Yadav' was written on the right hand of one of the deceased and 'J.K'. Was written on the right hand of the other deceased.

(3.) On the basis of this report, FIR was lodged as case No.71 dated 07.07.2009, under section 302 and 201 IPC and the police started investigation. Blood samples were taken by the police and on the basis of clothes worn by the deceased, the bodies were identified as that of Vipin Kumar s/o Jamuna Singh Yadav and Jasveer s/o Ramesh Harijan' both residents of Kapuri, Police Station Devband, District Saharanpur (U.P.).
