MAN MOHAN MODI Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This revision petition has been preferred by the petitioner Man Mohan Modi s/o Girdhari Lal , b/c Modi r/o Near Minerva Cinema, Chouthina Kua Area, Bikaner against the judgment and order dated 07.10.2010 passed by the learned Addl. Sessions Judge(Fast Track) No.2., Bikaner in Sessions Case No.29/2010 whereby the learned trial court framed charges under section 147, 148, 341,307 and 325 IPC and alternatively under section 325/149 and 323 IPC and alternatively under section 323/149 IPC against the petitioner and few others.

(2.) The brief facts of the case are that a FIR was lodged on 07.04.2010 by complainant Lokesh s/o Janak Raj bearing FIR No.74/2010 against Manish Panwar and few other unnamed persons, stating therein that on 06.04.2010 while he was standing near a Barber shop at about 10.30 PM Manish Panwar and about 7 to 8 other persons came and assaulted him on his head. On the basis of this report FIR was lodged under section 341, 323, 307 and 143 IPC. After investigation , police filed challan against the present petitioner Man Mohan Modi, Dhan Sukh @ Sethi , Arun swami and Rohit Godara under section 307,323,341,325,147,148 and 149 IPC in the court of learned Addl. Sessions Judge(Fast Track) No.2. Bikaner who vide order dated 07.10.2010, framed charges under section 307/147, 148,341 and 325 IPC against the petitioner and few others.

(3.) Being aggrieved by the order dated 07.10.2010 passed by the learned Addl. Sessions Judge (Fast Track) No.2. Bikaner in Sessions Case No.29/2010 the petitioner has preferred this revision petition.
