JUDGEMENT

(1.) The State of Rajasthan has preferred this application seeking leave of this court to file appeal under Section 378(i)(iii) Cr.P.C. against the order of acquittal dated 11/1/2011 whereby, the learned Additional District & Sessions Judge (Fast Track) Baran acquitted accused-respondents Bhupendra Kumar, Pappulal and Kunj Bihari of offences u/Ss.302 or 302/34 and 201 IPC extending them benefit of doubt.

(2.) Shri S.K. Mehla, learned Public Prosecutor has argued that the learned trial court gravely erred in acquitting the accused-respondents.

(3.) We have heard learned Public Prosecutor for the State and perused the impugned order of acquittal dated 11/1/2011.
