JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) This intra Court appeal is directed against the order dated 25.05.2011 passed by the learned Single Bench, whereby writ petition of respondent has been allowed and the order dated 13.10.2010, impugned in the writ petition, has been set aside.

Learned counsel for appellants referred the order dated 04.11.2009, whereby respondent was appointed as Director, Social Research Center, University of Rajasthan, Jaipur and submitted that from the order itself, it is clear that respondent was appointed for a period of three years or till further orders, whichever is earlier, therefore, there was no necessity to give any notice before passing the order dated 13.10.2010, whereby respondent was relieved from the post of Director. He further submitted that no reason whatsoever was assigned in the order dated 13.10.2010 for relieving the respondent, therefore, the said order cannot be treated as punitive in nature, as held by the learned Single Bench. So far as circumstances and background mentioned in reply to writ petition are concerned, the same were mentioned to satisfy the learned Single Bench that there was immediate need to pass the order, impugned in the writ petition. He, therefore, submitted that order passed by the appellant-University was absolutely legal, which has wrongly been set aside by the learned Single Bench, therefore, the order passed by the learned Single Bench may be set aside.
