MOHAMMAD NAVAJ Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) THIS application under Section 439 Cr. P.C., has been filed on behalf of accused -applicant Mohammad Navaj seeking bail in Criminal Regular Case No. 385/2003 (904/99) pending before the court of learned ACJM, Mount Abu.

(2.) HEARD learned Counsel for the applicant and the learned Public Prosecutor for the State. Perused the order impugned.

(3.) LEARNED Counsel for the applicant submits that if the applicant is granted bail, he will continuously appear before the trial court on each and every date of hearing and whenever called upon to do so till the completion of the trial and will not repeat the bail jump. He further submits that proceedings Under Section 446 Code of Criminal Procedure have been decided by the learned court below and trial will take time, therefore, the applicant may be released on bail.
