JUDGEMENT

(1.) HEARD learned Counsel for the Applicant and the learned Public Prosecutor and perused the Challan papers.

(2.) LEARNED Counsel for the Applicants submits that the prosecutrix has specifically stated that she was not violated physically, however, looking to the nature of the allegations made and the age of the prosecutrix, this Court is not inclined to accept this bail application. However, it is directed that the statements of the prosecutrix shall be recorded first at the trial since charge sheet has already been filed in the matter; and thereafter the Applicants shall be at liberty to file fresh bail application before the learned trial Judge and learned trial Judge shall decide the same without being prejudiced by the observations made by this Court.
