JUDGEMENT

(1.) COUNSEL submits that Petitioner had participated in the selection process initiated for the post of Teacher Gr.II (Sanskrit Education) and according to Petitioner, the cut off marks for SC Female category is 83.33, however, the Petitioner secured 84.03 marks but she has been declared ineligible due to his qualification. Counsel submits that Petitioner fulfills the academic qualification in terms of advertisement and if the Petitioner, despite being eligible and falling in merit, is not considered in the process of counseling, prejudice may cause to her. Counsel submits that in identical CWP3450/2011 while issuing notices interim order has been passed on 11/03/2011.

(2.) ISSUE notice of writ & stay petition to the Respondents along with copy of this order to show cause as to why the writ petition may not be disposed of finally at the stage of admission, returnable within four weeks. Notices may also be given 'dasti', if desired. Two sets of paper book of the petition may additionally be served upon Mr. S.N. Kumamat, who, as informed, is appearing in other connected matters, may seek instructions and inform to this Court, receipt whereof be filed in the registry, on its filing office to show his name in the cause -list. PF & notices be filed within seven days failing which stay order shall automatically stand vacated without reference to this Court.
