RAM NIWAS Vs. SMT. RAMPYARI AND ORS.

JUDGEMENT

(1.) Heard learned counsel for the parties.

(2.) Plaintiff/respondent filed a suit for permanent injunction in respect of disputed piece of land i.e. 'Chabutari', which was decreed by the trial Court and decree of the trial Court has been affirmed by the First Appellate Court while dismissing first appeal of defendant. Hence, defendant has preferred this second appeal.

(3.) Controversial issues involved in the present case are relating to question of facts and there is concurrent finding of facts by both the Courts below, which cannot be interferred with by this Court in second appeal under Sec. 100 CPC.
