JUDGEMENT

(1.) HEARD learned counsel for the parties.

(2.) THIS is second bail application under Section 439 Cr.P.C. First bail application of the petitioner was dismissed as withdrawn with liberty to move fresh bail application before trial court, in view of the fact that statements of some of the prosecution witnesses had been recorded after rejection of bail application by the trial on 17.08.2009.

(3.) IT is directed that the petitioner Ram Kalyan S/o. Shri Radha Kishan shall be released on bail under Section 439 Cr.P.C. in F.I.R. No. 42/2009 Police Station Sangod, District Kota(Sessions Case No. 40/2009 pending in the Court of Additional Sessions Judge(Fast Track) No. 1, Kota) provided he furnishes a personal bond in the sum of Rs. 50,000/-(Rupees Fifty Thousands) with two sureties of Rs. 25,000/-(Rupees Twenty Five Thousands) each to the satisfaction of the trial court to appear before that court on all dates and as and when he is called upon to do so by the trial court.
