(1.) you young couple, rising cheerfuly to the occasion and recognising your responsibilities in the house that is the abodeof joy, enjoying life by virtue of your own greatness, maintaining aspotless character, becoming proud parents and possessingan excellent house and living a meanigful life,pass through the brought and promising dawns." (ATHARVA - VEDA 14-2-43) The above advice of Atharva-Veda, turned into deaf ears of the wife and husband, theappellant and the respondent herein, who startedtheir married life in Nov. 1985 and withinten years of the marriage the husband approachedthe Family Court for dissolution of theirmarriage. Let us unfold the facts giving rise tothe instant miscellaneous appeal.
(2.) The respondent husband has succeeded in the Court below in seeking a decree of divorce against the appellant wife on the ground that he was treatedby his wife with cruelty and the lived a life of adultery after solemnization of her marriage with him. It is against this decree of divorce that the wife has preferred the instant appeal. For the sake of brevity we will hereafter refer the appellant wife and respondent husband by their respective names.
(3.) The marriage between Nidhi and Deepak was solenmized onNov. 25, 1985 accordingto Hindu rites and ceremonies. Both the partiescohabited at Jaipur and out of this wedlock one male child named Ashvin was born on Dec. 20, 1987.
