JUDGEMENT

(1.) THIS appeal is directed against the judgment date Jan. 7, 1989, of the District & Sessions Judge, Barmer, convicting and sentencing the appellant under Section 18 of the Narcotic Drugs and Psychotropic Substances Act,1985, (hereinafter referred to as the Act) to year's R. I. and a fine of Rs. one lac and in default of payment of fine to undergo one years further R. I.

(2.) THE petitioner was found to be in posseassion of 2 kg and 100 grams of opium which was recovered as a result of personal search effected by Avtar Singh Station House contention raised by the counsel for the peth one officer, city Kotwali, on Oct. 14. 1987. THE principal is that there was no. Compliance of sections 50 and 57 of the Act. Learned counsel has , in this connection, cited before me Biram vs. State of Rajasthan 1988 Cr. L. R. (Raj.) 79 1990 RCC 268 (1) and Bhanwar Singh vs. State of Rajasthan (2 ).
