JUDGEMENT

(2.) It is given out by Mr. S. Awasthi, learned counsel, that petitioner is working at Jaipur in Hariom Industries whereas the incident has taken place on 13.9.89 at 9.45 P.M. at Kishangarh The learned counsel for the petitioner has produced a photostat copy of the attendance register of the industry which shows that petitioner was on duty from 5 P.M. onwards for night.

(3.) In the facts and circumstances I am inclined to grant indulgence of the provisions of Sec. 438 Crimial P.C. to the petitioner. It is, therefore directed that in the event of arrest of petitioner Sohanlal in FIR No. 195/89 P. S. Kishangarh district Ajmer, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs. 5000.00 (Rupees five thousand only) with one surety in the like amount to the satisfaction of the I.O. Police Station Kishangarh, subject to the following conditions:-
