ASARPHI Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This criminal misc. petition has been filed assailing the order dated 02.12.2019 passed by the learned Judicial Magistrate Sapotra, District Karauli whereby the petitioner's application for release of a seized vehicle (tractor and trolley) has been dismissed.

(2.) It is contended by learned counsel for the petitioner that her tractor bearing registration no. RJ-34-RB-2586 with trolley not registered were seized by the respondent under Motor Vehicles Act for carrying illegal "bajri". He submitted that being owner of the tractor and trolley she applied under Section 457 Cr.P.C. in the Court of learned Judicial Magistrate Sapotra, District Karauli for release of the vehicle which has been dismissed vide order impugned.

(3.) Learned counsel submitted that no useful purpose will be served in keeping the tractor and trolley seized and the same may be released in her favour as she is ready to abide by the terms and conditions to be imposed by this Court.
