MOHMAD TOFFIQ Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Petitioners have filed this petition u/s 438 of Cr.P.C apprehending their arrest in connection with FIR No.561/2019 registered with Police Station Kotwali District-Sikar for the offence/s punishable u/s 147, 148, 149, 336, 143, 341, 323, 452, 427 and 504 IPC .

(2.) Learned counsel for the petitioners have contended that except Section 452 IPC all other offences are bailable. The petitioners have been falsely implicated in this case. Other co- accused persons Mohd. Tahir, Mohd. Imran and Mohd. Irfan have been granted benefit of anticipatory bail by the Co-ordinate Bench of this Court vide order dated 06.02.2020. The matter of the petitioners is not different from them. In pursuance of the direction of this Court dated 03.03.2020, the petitioners have appeared before the Investigating Officer. Hence, they may be granted benefit of anticipatory bail.

(3.) Learned Public Prosecutor has opposed the bail application.
