JUDGEMENT

(1.) The present criminal appeal under Section 14(A) (2) of the SC/ST (Prevention of Atrocities) Act has been filed in connection with FIR No.346/2019 registered at Police Station Sarmathura, Dholpur for the offences under Sections 323 , 341 , 504 , 354-B , 325 , 307 , 34 of IPC and Section 7 , 8 of Protection of Children from Sexual Offences Act, 2012 and under Section 3-1 (S) (W-I), 3-2(v) of SC/ST (Prevention of Atrocities) Act.

(2.) Counsel for the appellant submits that the allegation of inflicting injuries upon Birma and Ankit is against co-accused Lovekush and Ghanshyam. No injury has been attributed to the accused-petitioner. It is also submitted that co-accused Lovekush has been granted bail by the Court below. The case of the present accused-petitioner is not distinguishable from that of co-accused person, who has been granted bail. Accused petitioner is in judicial custody since 13.1.2020. Challan has already been filed and completion of trial will take a long time.

(3.) Learned Public Prosecutor assisted by counsel for the complainant has opposed the opposed the appeal.
