JUDGEMENT

(1.) This application for bail has been filed by the petitioner under Section 439 of the Cr.P.C. in connection with FIR No.177/2020, Police Station Dhambola, District Dungarpur, for the offences under Sections 458, 376, 323 IPC and Sections 3/4 and 16/17 of POCSO Act.

(2.) Learned counsel for the petitioner submits that the allegations alleged against the petitioner do not amount to abetment or involvement in the offence of rape; which is alleged to have been committed by Mukesh. It is also submitted that similarly situated co-accused Toofan has been enlarged on bail by a Coordinate Bench of this Court vide order dated 26.08.2020.

(3.) Learned Public Prosecutor opposed the bail application.
