JUDGEMENT

(1.) Heard on application for suspension of sentence.

(2.) Accused-appellant Morpal Meena S/o Shri Ram Lal has preferred this application under Section 389 Cr.P.C. in Sessions Case No.14/2014 (296/2014) titled as State of Rajasthan Vs. Nanda @ Nand Kishore & Ors.

(3.) It is contended by counsel for the accused-appellant that present appellant has been convicted by the judgment dated 07.09.2019 of Additional Sessions Judge No.17, Jaipur Metropolitan Jaipur for offence under Sections 399 and 402 IPC and sentenced to rigorous imprisonment for seven years and five years respectively. It has been contended on behalf of the petitioner that his first application for suspension of sentence was dismissed as withdrawn on 15.11.2019. There is no evidence to connect him with the offences. Disposal of appeal may take time. There is no any other previous case against the accused-appellant. He has no criminal record. He is only bread earner of his family. It is requested that his sentence may be suspended.
