MAHENDRA Vs. SATATE OF RAJASTHAN

JUDGEMENT

(1.) The petitioner has assailed the order dated 25.02.2020 passed by the learned Additional Sessions Judge (Women Atrocities) No.2, Jaipur Metropolitan in revision petition No.09/2020(CIS No.106/2020) whereby the revision petition preferred by the petitioner was dismissed. The revision petition was preferred against the order dated 07.01.2020 passed by the Appellate Authority-cum-Chief Conservator of Forest, Jaipur in Appeal No.8/2019 who dismissed the appeal preferred by the petitioner against the order dated 24.09.2019 passed by the Authorized Officer-cum- Assistant Conservator of Forest, Rajgarh (Alwar) whereby Authorized Officer-cum- Assistant Conservator of Forest confiscated tractor along with trolley bearing registration No.RJ-02/RD-5431 used in transporting forest mineral/stones.

(2.) Learned counsel for the petitioner submits that no useful purposes will be served keeping the tractor and trolley in custody, it may deteriorate its condition which will be national wastage. There is no statutory bar to release the vehicle on Supurdginama.

(3.) Thus, considering all the facts and circumstances of the case, I deem it just and proper to allow the petition under Section 482 Cr. P. C. for securing end of the justice.
