JUDGEMENT

(1.) This criminal misc. petition has been filed assailing the order dated 24.01.2020 passed by the learned Additional Sessions Judge No.1 Kishangarh, Ajmer dismissing the Criminal Revision Petition No.24/2019 preferred by the petitioner against the order dated 22.05.2019 passed by the learned Additional Chief Judicial Magistrate No.2 Kishangarh, Ajmer in Criminal Complaint No.519/2016, whereby, the application filed by the petitioner- accused under Section 91 Cr.P.C. to take on record a document, was rejected.

(2.) Heard learned counsel for the petitioner through 'Jitsi Meet'.

(3.) It is contended by learned counsel for the petitioner that the learned courts below erred in rejecting his application to take the document on record, which was in the shape of receipt representing payment of the cheque amount to the complainant, which was whole basis of his defence. He submits that the learned Courts below erred in rejecting the application observing the receipt to be forged prima facie without subjecting the same to the scrutiny of the evidence. He, therefore, prays for this criminal misc. petition to be allowed and the orders impugned be quashed.
