DAYARAM Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This bail application has been filed under Section 439 Cr.P.C.

(2.) Brief facts of the case are that an FIR No.654/2019 was registered at P.S. Bansoor, District Bhiwadi for the offences mentioned therein against the accused petitioner. During the course of investigation, the accused petitioner was arrested. Thereafter he moved the bail application before the trial court, which vide impugned order dismissed the same. Hence this bail application has been filed on behalf of the petitioner.

(3.) Learned counsel for the petitioner has contended that the petitioner has falsely been implicated in this case. Counsel further submits that challan has already been filed. As per the post mortem report of deceased, single injury punctured suggestive of fire-arm entry, is found over right temporal region. Counsel further submits that applicant had not used any fire-arm. The fire-arm has been recovered from accused Sishram. The applicant has no criminal antecedents. As per the FIR, there was previous enmity between the complainant and accused Sishram. It has also been contended that the accused petitioner is in judicial lockup since long, trial of the case is likely to take time, hence the accused petitioner be released on bail.
