SUDHEER Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This bail application has been filed by the petitioner under Section 439 CrPC seeking regular bail in FIR No. 102/2018 registered at Police Station, Malsisar, Distt. Jhunjhunu for the offence under Sections 147 , 149 , 323 , 341 , 365 , 302 , 452 & 120B IPC.

(2.) Learned counsel for the petitioner has submitted that the petitioner has not been named in the FIR. He is in judicial custody since 11.9.2019 and the conclusion of trial is likely to take long time. Co-accused Avinash and Sandeep S/o Ghisaram have been granted bail by the Coordinate Bench of this Court vide order dated 11.2.2020 in S.B. Cr. Misc. Bail Application Nos. 451/2020 and 1069/2020 respectively; co-accused Sandeep Kumar S/o Shri Suresh Kumar has been granted bail by the Coordinate Bench of this Court vide order dated 20.11.2019 in S.B. Cr. Misc. Bail Application No. 15870/2019 and co-accused Tayub Ali has been granted bail by the Coordinate Bench of this Court vide order dated 20.11.2018 in S.B. Cr. Misc. 2nd Bail Application No. 14698/2018. After the completion of investigation, challan has been filed and now the petitioner is not required for any investigation or interrogation purposes, hence he may be enlarged on bail.
