Counsel for the petitioner submits that the application for grant of 60 seats in BAMS (UG) Course for the Session 2019-20 as rejected on two counts, namely, that the NOC granted by the State Government stood expired in May, 2019 and secondly, on the ground that regular hospital staff was not available.
(2.) Learned counsel submits that the petitioner intends to move a fresh application for Session 2021-22 after providing regular hospital staff. However, their application is likely to be rejected on the ground that the NOC issued by the State Government has expired in May, 2019 and therefore, this Court should declare that the NOC is valid even for fresh application.
(3.) Learned counsel also submits that the validity of the NOC could not have been looked into and the application could not have been rejected on the ground that it is not in Form-4 as it is the contents, which are required to be looked into and not the format in which the NOC has been issued.
