NIHARIKA SHARMA Vs. RAJASTHAN PUBLIC SERVICE COMMISSION

JUDGEMENT

(1.) Counsel for the petitioner submitted that in pursuance to the advertisement dated 02.04.2018, the petitioner applied for the post of Rajasthan State and Sub-ordinate Services (Direct Recruitment by Combined Competitive Examination), 2018. Counsel further submits that due to bona-fide mistake while filing up the application form the petitioner has filled the category as 'Non-Gazetted Employees' in place of 'General Women'. Counsel further submits that no third party rights have been created as the process of selection is still going on.

(2.) In support of contention, counsel for the petitioner relied upon the judgment passed by the Division Bench of this court in the matter of Kavita Choudhary Vs. The Registrar (Examination), Rajasthan High Court, Jodhpur (D.B. Civil Special Appeal (Writ) No.1700/2017) decided on 01.11.2017 wherein it has been held as under:-

Counsel for the respondents has opposed the submissions made by counsel for the petitioner and submitted that thrice opportunity was given to the candidate for correction in her application form and since the petitioner failed to correct the application form in time, therefore, no relief can be granted to the petitioner.
