BALKRASHAN Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present 2nd bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No. 397/2019 registered at Police Station Kherli, District Alwar for the offence(s) under Section(s) 323, 341, 326, 452, 325, 307, 452, 147, 148, 149 of Indian Penal Code .

(2.) Heard learned counsel for the petitioner through 'Jitsi Meet'.

(3.) It is contended by learned counsel for the petitioner that although it is alleged against the petitioner that he inflicted injury on the person of Naresh with sharp edged weapon; but, recovery of lathi has been effected from him. He submits that there is no medical opinion as to the nature of injury suffered by injured Naresh to be dangerous to life and hence, the scope of offence does not travel beyond the scope of Section 325 of I.P.C. He submits that the petitioner is in custody for about four months, charge-sheet has been filed, trial of the case will take time, co- accused persons have already been enlarged on bail by this Court and prays for release of the petitioner on bail.
