JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.95/2019 registered at Police Station Kishangarh Bas, District Bhiwadi (Alwar) for the offence(s) under Sections 498A & 304B of I.P.C. later on charge-sheet was submitted for the offence under Sections 498A and 306 IPC.

(2.) Heard learned counsel for the petitioner through 'Jitsi Meet'.

(3.) It is contended by learned counsel for the petitioner that from the material on record in the shape of charge-sheet, it is apparent that no offence under Section 306 IPC is made out against the petitioner even prima facie; rather, the same reveals that the deceased committed suicide on her own without any instigation by the petitioner as she was caught having extra marital affairs. He submits that the petitioner is in custody since 10.01.2020, charge-sheet has already been filed, similarly situated co-accused Juhuru has already been extended benefit of bail by this Court dated 05.03.2020, trial of the case is likely to take time and prays for release of the petitioner on bail.
