SOYAL Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Petitioner through his natural guardian mother has preferred this revision petition aggrieved by order dated 10.02.2020 passed by Juvenile Justice Board, Kota whereby application under Section 12 of the Juvenile Justice (Care and Protection of Children) Act was rejected and against order dated 18.02.2020 passed by Special Judge, Protection of Child From Sexual Offences Act, 2012 and the Commissions for Protection of Child Rights Act , No.1, Kota whereby appeal filed by the petitioner was rejected.

(2.) Learned counsel for the petitioner submits that the petitioner is a juvenile and was arrested in a case where allegations are of fight which occurred in between same age children and allegations are of having injured the other boy with knife.

(3.) Keeping in view his age and sudden incident, it would be advised to allow his custody under the guidance of his parents.
