NARESH SINGH Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Heard learned counsel for the petitioners through Video Conferencing as well as learned Public Prosecutor, present in the Court.

(2.) Learned counsel for the petitioners submitted that the present accused-petitioners have not caused any injury on the person of the deceased-Bhanwari Devi. Learned counsel for the petitioners submitted that the son of the deceased Sohanlal is an eye witness and he has specifically said about fatal injuries being caused by Prabhu Singh on the head of his mother by a weapon 'axe' (Kulhari).

(3.) Learned counsel submitted that there are general allegations against the petitioners and injury report and postmortem report specifically refers to one injury i.e. a lacerated wound on the left side of the parietal temporal region. Learned counsel for the petitioners submitted that no other injury is suffered by the deceased and as such the petitioners cannot be alleged to have caused any injury.
