JUDGEMENT

(1.) Instant writ petition has been filed by the petitioner challenging the order dated 26.10.2009 (Annexure-30) passed by the Rajasthan Civil Services Appellate Tribunal, whereby the appeal filed by the petitioner was dismissed.

(2.) Brief facts of the case are that the petitioner was initially appointed as "Beldar" in the respondent-Department and while working on the said post, he submitted an application dated 05.03.2002 for seeking voluntarily retirement. The respondents vide order dated 23.03.2002 accepted the application submitted by the petitioner and the petitioner was retired from service vide order dated 23.03.2002. After passing of the order of voluntarily retirement, the respondents have also paid all due retiral benefits to the petitioner.

(3.) Counsel for the petitioner submits that the petitioner was working on the post of "Mate" and the respondents have wrongly treated the petitioner as "Beldar".
