JUDGEMENT

(1.) This IInd bail application has been filed under Section 439 CrPC in connection with FIR No.92/2019 registered at Police Station Shahbad Distt. Baran for the offences under Section 376 , 506 IPC.

(2.) Heard learned counsel for the petitioner through video conference as well as learned Public Prosecutor.

(3.) Learned counsel for the petitioner submits that the charges have been framed u/s 376 and 506 IPC while there is no charge framed with regard to the petitioner having made recording of the prosecutrix. It is submitted that even in the charge sheet, no document has come on record to show that recording was made by the petitioner. The prosecutrix is married woman and it is mentioned that incident has been alleged to have been taken place before three months of lodging FIR.
