DEENDAYAL Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C. seeking regular bail in connection with F.I.R. No. 14/2020 registered with Police Station Mahaveerji, District Karauli, for the offences punishable under Sections 376, 354B, 450, 452, 506 of I.P.C.

(2.) Heard learned counsel for the accused petitioner through video conferencing.

(3.) It has been submitted on behalf of the accused petitioner that he has been falsely implicated in this case as an after-thought. As per the statement of the prosecutrix recorded under Section 161 of Cr.P.C. the incident took place on 08.11.2019 but complaint was lodged on 02.12.2019 and F.I.R. was registered on 11.01.2020, regarding which there is no plausible explanation of the prosecution. Parties have filed compromise in the learned trial court. Copy of the affidavit regarding compromise has been filed along with the bail application, in which it has been written by the prosecutrix that accused petitioner did not commit any wrong against her and F.I.R. was lodged as tutored by the people. Charge-sheet has been filed in this case. Trial of the case may take time.
