JUDGEMENT

(1.) Learned State counsel submits that the complainant has been informed through a telephonic call on 28.05.2020, in spite of that, none appeared on his behalf.

The instant appeal has been filed under Section 14A(2) of SC/ST (Prevention of Atrocities) Act on behalf of the appellant, who is in custody in connection with FIR No. 397/2019, Police Station Udaipurwati, District Jhunjhunu for the offences under Sections 147 , 148 , 149 , 341 , 323 , 427 and 302 I.P.C. and Section 3(2)(Va) of the SC/ST (Prevention of Atrocities) Act against the order dated 23.12.2019 passed by the Special Judge, SC/ST (Prevention of Atrocities) Cases, Jhunjhunu, whereby, the bail application preferred under Section 439 Cr.P.C. on behalf of the appellant was rejected.

(3.) Learned counsel for the appellant has submitted that appellant is innocent. Charge-sheet has been filed. Learned counsel has further submitted that co-accused Ratanlal, Vishnu Gurjar and Phool Chand have been enlarged on bail by the coordinate bench of this Court. Appellant is in judicial custody since long and trial of the case will take a long time, hence, he may be enlarged on bail.
