JUDGEMENT

(1.) Petitioners have preferred this D.B. Civil Writ Petition seeking quashing of Rule 10-B of the Rajasthan Prisoners Release on Parole (Amendment) Rules, 2020.

(2.) It is contended that in the wake of Covid-19 pandemic to ease the population of p ease the population of prisoners in the prison, Government has issued notification inserting Rule 10-B in the Rajasthan Prisoners Release on Parole Rules.

(3.) It is argued that Rule 10-B is ultra vires to the Constitution of India as it is giving special parole to a category of prisoners and is excluding the prisoners who have been convicted for offences related to acid attack, rape, dacoity, murder, Section 4 or 6 of the POCSO Act,NDPSAct , economic offences, Prevention of Corruption Act , Prevention of Money Laundering Act , Anti national activities, unlawful activities (Prevent activities, unlawful activities (Prevention Act ) or any other offences of similar nature or the cases investigated by any Central Investigating Agency.
