SANDEEP Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.04/2020 registered at Police Station Devli District Tonk for the offence(s) under Section(s) 354-A, 354, 457 & 509 IPC and Section 67-A of the I.T. Act.

(2.) Heard learned counsel for the petitioner through 'Jitsi Meet'.

(3.) It is contended by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He contended that as per the FIR and the statement of prosecutrix, the allegation of commission of rape upon her was against co-accused Sanjay Singh who has already been extended benefit of bail by a Coordinate Bench of this Court vide its order dated 29.05.2020. He submits that the petitioner is in custody since 06.01.2020, charge-sheet against him has been filed, trial of the case will take time and prays for release of the petitioner on bail.
