(1.) This petition has been filed under Article 226 of the Constitution of India for parole of 07 days under 18 of the Rajasthan Prisoners (Release on Parole) Rules, 1958 (hereinafter to be referred as ' the Rules of 1958').
(2.) Learned Counsel for the petitioner submits that the petitioner is admittedly eligible for parole of 07 days as per Rule 18 of the Rules of 1958. His conduct in jail has been reported to be satisfactory but only due to earlier absconding, release of parole has been denied by the authorities. He has placed reliance on the order of this Court passed on 12.09.2018 in D.B.Criminal Writ Petition (Parole) No.909/2018- Nimiya @ Nemichand Vs. State of Rajasthan & Ors. vide which, 7 days regular parole was allowed in similar circumstances.
(3.) Learned Counsel for the respondents has opposed the submissions.
