JUDGEMENT

(1.) The bail application has been filed under Section 438 CrPC. in connection with FIR No.187/2020 registered at Police Station Rajgarh District Alwar for the offences under Section 143 , 323 , 341 IPC whereupon the investigation was commenced. Apprehending their arrest, the petitioners moved the bail application before the court below, which were dismissed. Hence, the bail application has been filed.

(2.) Learned counsel for the petitioners submits that in the FIR allegations levelled were only in relation to Section(s) 143, 323, 341 IPC . There is no allegation or even indication of the petitioners having molested any female. However, later on the statement was recorded under Section 164 Cr.P.C. of one lady who has made allegation which has been made as basis for rejecting the bail of the petitioners. Counsel submits that charge sheet has already been filed.

Taking into consideration the above said facts but without commenting further on merits, this bail application filed under Section 438 CrPC is allowed and it is directed that in the event of arrest of petitioner Ramswaroop S/o Shri Kishan Lal, Hariprasad @ Hariram S/o Shri Kishan Lal, Shravan Kumar S/o Shri Hariprasad @ Hariram, Motilal S/o Shri Hariprasad @ Hariram, Pawan Kumar S/o Shri Hariprasad @ Hariram, Deendayal S/o Shri Ramswaroop and Santosh S/o Shri Ramswaroop in the aforesaid FIR, they shall be released on bail by the concerned Investigating Officer, provided each of them furnish a personal bond in the sum of Rs. 20,000/- with one surety in the like amount to his satisfaction on the following conditions:
