JUDGEMENT

(1.) This bail application has been filed under Section 438 Cr.P.C. in connection with FIR No. 38/2019 registered at Police Station, Sindhi Camp, Jaipur for the offences under Sections 448 , 506 , 509 , 453 IPC.

(2.) Investigation Officer was called who is present. It is noticed that this court had granted interim protection to the accused petitioner for appearing before the Investigation Officer for interrogation on 8.1.2020. He has appeared before the Investigation Officer on 8.1.2020.

Itis submitted that the complainants are old couple of above the age of 70 years and earlier they have filed a case for eviction against the accused petitioner wherein the accused petitioner had given an assurance in this High Court in a writ petition for vacating the rented premises situated on the first floor. He was to vacate the premises in December, 2018. It is also submitted that when he was to vacate the first floor, he wrongfully encroached upon the room, which was constructed on the second floor and shifted his household materials in the second floor without having any authority. It is stated that the second floor was not rented out to the accused petitioner.
