JUDGEMENT

(1.) This criminal miscellaneous petition has been filed by the petitioner for quashing the FIR No.309/2019 registered at Police Station Nadoti, District Karauli.

(2.) Heard learned counsel for the petitioner through 'Jitsi Meet'.

(3.) It is contended by the learned counsel for the petitioner that just to victimize and harass the petitioner, the instant FIR was lodged against him; otherwise, there is cross-FIR bearing No.310/2019 against the complainant party in which police after investigation has filed charge-sheet for offence under Section 307 of IPC against as many as five accused persons. He submits that the ingredients to constitute offence under the Schedule Castes and Scheduled Tribes (Prevention of Atrocities) Act , 1989 are lacking in the instant FIR. He further contends that in view of the averments in the cross-FIR, it cannot be said that offence under Sections 323 & 341 is made out against the petitioner. He, therefore, prays for quashing the FIR No.309/2020.
