BHAIRULAL Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) These present second bail applications have been filed under Section 439 Cr.P.C. The petitioners have been arrested in connection with FIR No. 164/2019 registered at Police Station Sadar Jhalawar, District Jhalawar for the offence(s) under Section(s) 394 of IPC .

(2.) It is contended by learned counsel for the petitioners that after rejection of their first bail application, similarly situated co- accused Rajababu has been extended the benefit of bail by a co- ordinate Bench of this Court vide its order dated 09.07.2020 on the premise that Devkaran, complainant in the case did not support the prosecution story and turned hostile as PW-2. He claims benefit of bail for the petitioners on the ground of parity.

(3.) Learned Public Prosecutor has opposed the second bail applications.
