MAHESH KUMAR Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present 3rd bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.232/2018 registered at Police Thana Kaladera District Jaipur for the offence(s) under Sections 306 of IPC.

(2.) Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter. Counsel further submits that in the revision petition filed by co-accused Shravan Kumar Bagda, further proceeding during trial qua co-accused Shravan Kumar Bagda has stayed by the Co-ordinate Bench of this court vide order dated 17.05.2019 passed in S.B. Criminal Revision Petition No.835/2019. Counsel further submits that the trial court is not proceeding in the matter and the petitioner is in custody since 24.10.2018 and prayed that the petitioner be released on bail. In support of his contention counsel relied upon the judgment passed by the Hon'ble Supreme Court in the matter of Babu Singh and Others Vs. The State of U.P. reported in AIR 1978 Supreme Court 527.

(3.) Learned Public Prosecutor has opposed the bail application.
