SURENDRA Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present appeals have been filed under Section 14 of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act , 2015 (for short "the Act of 2015"). The appellants have been arrested in connection with FIR No.481/2019 registered at Police Station Todaraisingh, District Tonk for the offence (s) under Section(s) 143, 341, 342, 323, 365, 307 and 379 of IPC and Sections 3(1)(S)(R) and 3(2)(V) of the Act of 2015 later on for offences under Sections 147 , 148 , 341 , 323 , 342 , 365 , and 302/149 of IPC and Sections 3(1)(R)(S), 3(2)(V) (V- A) of the Act of 2015.

(2.) Heard learned counsel for the appellants through 'Jitsi Meet'.

(3.) It is contended by learned counsel for the appellants that there are omnibus allegations in the FIR with no specific overt act assigned to the present appellants of causing injury on the person of deceased. He submits that the appellants are in custody for more than four months, charge-sheet has been filed, trial of the case will take time, similarly situated co-accused persons namely Dharamraj, Rajesh & Ramjilal have already been extended benefit of bail by a Coordinate Bench of this Court and prays for their release on bail.
