GOMI BAI Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No. 232/2020 registered at Police Station Nainwa, District Bundi for the offence under Section(s) 341, 323 & 34 IPC and later on for the offence under Section(s) 341, 323, 325 & 308 IPC.

(2.) It is contended by the learned counsel for the petitioner that even if the prosecution case is taken to be true on its face value, offence against the petitioner does not travel beyond the scope of Section 325 IPC which is bailable. He submits that the petitioner is in custody for about last two months, investigation as against her is complete, she has no criminal antecedents and prays for her release on bail.

(3.) Learned Public Prosecutor has opposed the bail application.
