JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.124/2019 registered at Police Station Sez, District Jaipur (West) for the offence(s) under Section(s) 323, 341, 308, 452, 379 & 34 of IPC and later on for offences under Secctions 323, 341, 308, 427 & 120-B of IPC .

(2.) Heard learned counsels for the parties through 'Jitsi Meet'.

(3.) It is contended by learned counsel for the petitioner that no overt act has been assigned to the petitioner in the FIR. He submits that the petitioner is in custody since 23.05.2020, no recovery has been effected from him, the case does not travel beyond the scope of Section 308 IPC as found by the Investigating Agency after thorough investigation. He submits that similarly situated co-accused Praveen Kumar has already been extended benefit of bail by a Coordinate Bench of this Court vide order dated 25.02.2020 and prays for his release on bail.
