NIKHIL Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) This bail application has been filed by the petitioners under Section 439 CrPC seeking regular bail in FIR No. 90/2020 registered at Police Station, Kotwali, Baran for the offence under Sections 341 , 323 , 307 , 34 IPC.

(2.) Learned counsel for the petitioners has submitted that the accused petitioners are innocent. The nature of the injury for the offence under Section 307 IPC is simple in nature as it has been caused on non vital part of the body. After the completion of investigation, challan has been filed. The petitioners are in judicial custody since long and the conclusion of trial will take long time, hence they may be enlarged on bail.

(3.) Learned PP appearing for the State has opposed the same.
