JUDGEMENT

(1.) Petitioner has filed this bail application under Section 439 Cr.P.C.

(2.) F.I.R. No.134/2019 was registered at Police Station Itawa, District Kota for offence under Sections 307, 341, 323, 34 of I.P.C.

(3.) It is contended by counsel for the petitioner that there is cross F.I.R. Petitioner has remained in custody for a period of fourteen months. Out of twenty one witnesses, statement of only three witnesses have been recorded so far. Doctor has been examined. As per the statement of doctor, initially there was a cut wound and subsequently there was a stab wound. Doctor has admitted in his cross examination that a cut wound was a superficial wound. It is also contended that there were two perforations in intestine, whereas there was only one wound in stomach. Doctor is not able to explain as to how wound perforations were caused. It is also contended that as per the charge sheet, similar charges have been levelled against Chetan who has been enlarged on bail.
