VINAY SHARMA Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) In S.B. Cr. Misc. Bail Application No.5860/2020: This bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.0269/2020 registered at Police Station, Pratap Nagar District Jaipur City East, for offence under Section(s) 8/21 of NDPS Act and Section 51 of Disaster Management Act.

(2.) Learned counsel for the petitioner submits that quantity of contraband recovered from the petitioner is less than the commercial quantity and recovery itself is doubtful and it is essentially a case under the Disaster Management Act.

(3.) Learned Public Prosecutor has opposed the bail application. Taking into consideration the nature of the allegation levelled against the petitioner, but without commenting on merits of the case, I deem it just and proper to enlarge the petitioner on bail.
