USMAN Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) Learned counsel for the appellant/s has/have annexed the certificate under Rule 311(3)of High Court Rules to the effect that he/she/they was on bail during the course of trial as well as appeal and presently he/she/they is in judicial lockup. Hence, the execution of sentence awarded to the petitioner/s should be suspended during the pendency of the appeal.

(2.) Heard learned counsel on suspension.

(3.) The accused petitioner is alleged to have raped the prosecutrix who was stated to be mentally retarded.
