JUDGEMENT

(1.) This criminal miscellaneous petition has been filed by the accused-husband for quashing the FIR No.233/2020 dated 07.05.2020 registered at Police Station Mahuwa, District Dausa under Sections 498-A , 406 & 323 of IPC.

(2.) Heard learned counsels for the parties through 'Jitsi Meet'.

(3.) It is contended by the learned counsel for the petitioner that marriage between the parties took place about ten years ago and on account of some bonafide error and misconception, the instant FIR came to be lodged on behest of the respondent No.2. He submits that the parties are husband and wife for last ten years, are residing as such as on today also and after lodging the FIR, they have resolved their dispute amicably. He submits that the complainant-respondent No.2 has already filed her affidavit acknowledging amicable settlement of dispute between the parties before the learned trial Court and a copy whereof has been placed on record as Annexure-2 along with the criminal miscellaneous petition. In these circumstances, he prays for quashing the FIR.
