LALSINGH Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No.16/2020, Police Station Baap, District Jodhpur, registered for the offence under Sections 8/15, 29 of N.D.P.S Act.

(2.) Heard and considered the arguments advanced by the learned counsel for the petitioner appearing through video conferencing and learned Public Prosecutor present in person. Perused the material available on record.

(3.) Learned counsel for the petitioner stated that recovered quantity is below commercial quantity and the recovery of alleged contraband was made from the Nemi Chand, who has been granted benefit of bail by the co-ordinate Bench of this Court. He further submits that trial will take time, therefore, benefit of bail may be granted to the accused-petitioner.
