VIKRAM BAGARI Vs. STATE OF RAJASTHAN

JUDGEMENT

(1.) The petitioner has filed this bail application under Section 439 Cr.P.C. in FIR No.05/2020 registered at Police Station Ramganjmandi, District Kota for the offence under Sections 354 of IPC and Sections 7/8 of Prevention of Children From Sexual Offences Act, 2012.

(2.) Learned counsel for the petitioner submits that in this matter FIR has been lodged by mother of the prosecutrix, in which no allegation of rape has been mentioned and the age of the prosecutrix is also mentioned as 18 years. This is a case of animosity. Both the parties are relatives. It is submitted that after lodging of the FIR, material improvements have been made and false allegation of rape has been levelled against the petitioner. No criminal case except this is registered against the petitioner. The petitioner is in custody since 21.01.2020. Challan has been presented and conclusion of trial will take time.

(3.) Learned Public Prosecutor has opposed the bail application.
