JUDGEMENT

(1.) The petitioner challenges the order dated 22 nd May, 2020, whereby the stay earlier affected on construction of the house has been vacated by the Block Development Officer, Gram Panchayat Singhana.

(2.) Learned counsel submits that the order has been passed without even giving any hearing to the petitioners.

(3.) This court finds that the order passed by the Block Development Officer, Gram Panchayat Singhana is revisable by the Collector. At the same time, this court is also of the prima facie view that there was no occasion to vacate the interim order at this stage during COVID-19 pandemic. Accordingly, the petitioners are directed to file a revision petition before the Collector, Jhunjhunu who will examine the facts of the case on merits and may also get the inspection done, if required. Till the Collector decides the revision petition, no construction shall be made on the disputed site.
